Event Terms & Conditions

The Yajilarra Festival culture night and music festival (the Event) to be held on 14th July 2023 and 15th July 2023 (Event Dates) at Town Oval, Fitzroy Crossing (the Venue) is presented by Bunuba Cultural Conservation Institute Limited, ABN 58 646 186 085 (the Event Organiser) of Fitzroy Crossing WA 6765.

This agreement creates a contractual relationship between the Event Organiser and the individual/company who attends the Event (the Participant).

COVID-19

Yajilarra Festival events are conducted in accordance with the Western Australian Government’s COVID-19 restrictions. All attendees must comply with any COVID-19 safety protocols as directed by the venue, artist, or the Western Australian Government.

If you are showing symptoms of COVID-19 or are required to isolate according to Western Australian Government directions, you must not attend the Festival. Please contact info@yajilarrafestival.com.au prior to the event, with at least 24 hours’ notice to arrange a remedy. Yajilarra Festival reserves the right to request proof of a positive result when a refund is requested.

A remedy will not be offered due to fear of exposure of COVID-19 or if they contact the Yajilarra Festival after their event has passed. If one person in a party has contracted COVID-19, a remedy may not be offered to the remaining group members. No remedy will be offered if you are refused entry to a venue for not adhering to the COVID-19 safety requirements.

If events are cancelled for reasons relating to COVID-19, including if artists cancel a performance due to illness, a remedy will be offered to all ticket holders of any performances affected.

Remedies include exchanges to another performance of the same event (subject to availability), gifting the cost of the tickets to the artist, or receiving a refund for the ticket cost. Refunds may take up to 28 days to process.

Ticketing

Booking Fees and Taxes

All bookings are by VISA or Mastercard credit/debit card only. Any discounted ticket offer only applies to the ticket price. Any ticket purchases are inclusive of GST, where applicable.

Refunds

No refunds are available unless a performance is cancelled, re-scheduled or significantly re-located (and you cannot or do not wish to attend the rescheduled or relocated event), or in accordance with our COVID-Safety measures outlined above.

Refunds for tickets purchased by credit card will be refunded to that credit card. Tickets purchased by cash, cheque or EFTPOS will be refunded by direct EFT deposit. Auxiliary expenses incurred by you in connection with your attendance or non-attendance at an event, including a cancelled, rescheduled or significantly relocated event, will not be refunded.

Exchanges

Exchanges are only permitted to another performance of the same event, subject to availability.

Any exchanges must be made at the original point of sale and will be subject to exchange fees unless the exchange is as a result of complying with COVID safe practises or government health directives.

Where an exchange is made to a less expensive ticket type or performance date, the price difference will not be refunded. Where an exchange is made to a ticket type or performance date of equal or greater value any additional cost plus the exchange fee must be paid at the time of the exchange.

Exchanges must be requested at least 24 hours in advance of the original performance time.

Concessions

Holders of valid concession cards are eligible for concession price tickets: Student card (full-time), MEAA membership card, Carer Card, Health Care Card, Pension Card, Veterans Affairs Card, all government-issued Seniors Cards. You may be asked to show your valid concession card when purchasing or collecting your tickets and/or on entering the venue. Concession prices are not applicable on all events or performances.

Groups

Some events will offer discounts for booking multiple tickets. The number in brackets next to ‘Group’ indicates how big your group needs to be in order to qualify for the group discount. Prices listed are per ticket. Group prices are not applicable on all events or performances.

Children under 2 (Babes-in-arms)

Unless otherwise specified, children under the age of two do not need a ticket. Please note this means children will need to sit on your lap (for in-person events) as they will not have a seat. Please be mindful of the show’s content when taking along a small child. Please note, babes-in-arms are not allowed entry to any events that are specified 18+.

Discounts

Any advertised discounts apply to full price tickets only.

Accessibility and Companion Cards

All ticketed events accept Companion Cards. To book a companion ticket using your companion card, please contact the Yajilarra Festival at info@yajilarrafestival.com.au.

Conditions of Entry

Upon entry to a venue, ticket holders agree to be captured by photography or video for promotional use of the Yajilarra Festival. It is also a condition of entry to a performance that no recording or photographic devices are used. Including mobile phones, which must be switched off prior to the beginning of the performance. Your fellow Participants and performers/artists will be delighted by your manners.

E-Tickets

Tickets purchased online at https://www.yajilarrafestival.com.au will be issued as E-Tickets. This requires customers to have a valid email address. Please ensure you have checked your spam folder if you have not received the tickets to your inbox. For in person events, E-Tickets can be printed or presented at the venue on a smartphone or tablet. If printed, please ensure that the QR code is clear and able to be scanned. Ticket barcodes should be kept securely and treated like cash.

Payment

If you are unsure if a payment has gone through, please contact Yajilarra Festival Ticketing at info@yajilarrafestival.com.au before attempting to pay again. Yajilarra Festival reserves the right to not provide refunds if payment has been successful. If payment has been unsuccessful, we can happily help you secure your tickets.

Yajilarra Festival accepts ONLY Visa and Mastercard for online sales.

Ticket Resale

Tickets may not, without prior written consent from the Yajilarra Festival, be resold at a premium, offered as a prize or used for advertising or other promotional use. A ticket purchased from a reseller does not guarantee you entry to the event.

Program details and prices

Every effort has been made to ensure program details are correct, however details and prices are subject to change where necessary and without notice.

If the cost of an event has changed to a lower price, refunds in the difference will not be offered to existing ticket holders.

Terms of Sale

Please read these Terms of Sale prior to purchasing a ticket for any event presented in the Yajilarra Festival program. By purchasing a ticket to the Yajilarra Festival event, you are agreeing to these Terms of Sale.

Conditions of purchase

The ticket cannot be returned or refunded after purchase except as provided for in the LPA Code of Practice for Event Ticketing.

The right is reserved to add, withdraw or substitute artists, performers or events, vary ticket prices, and/or vary advertised programmes, seating arrangements and audience capacity.

The right of admission is reserved by the venue and/or entrepreneur and/or its agent. Late arrival may result in non-admission.

It may be a condition of entry to individual events that a search of the person and/or their possessions will be required at the time of the entry to the venue.

Entry may be refused if tickets are damaged or defaced in any way or are not purchased from the Yajilarra Festival or other authorised points of sale.

Professional cameras, video cameras and other recording devices are not permitted.

If other conditions apply, they are displayed either in the box office or near the entrance to the venue.

By purchasing a ticket, attending an event or otherwise dealing with the Yajilarra Festival, you agree to be bound by the Yajilarra Festival privacy policy.

These Terms of Sale are governed by the laws of Western Australia.
